General Terms and Conditions of Drivos Oy

1. Scope and Seller Information

These General Terms and Conditions apply to transactions between Drivos Oy and its customers in the Drivos online store. These Terms also apply, where applicable, to other sales unless otherwise agreed separately in writing with the customer.

Consumer transactions are governed by Finnish consumer protection legislation. These Terms do not restrict any statutory rights granted to consumers.

Transactions with business and organisational customers are governed by the Finnish Sale of Goods Act and these Terms, unless otherwise agreed in writing between the parties.

2. Customers and Customer Information

Customers of Drivos Oy may be consumers, businesses and organisations.

When placing an order, the customer must provide complete and accurate information, including their name, delivery address, billing address, telephone number and email address. Business customers must also provide the company name and Business ID or other applicable company registration number.

The customer is responsible for the accuracy of the information provided. Drivos Oy is not liable for delays in delivery or other problems caused by incorrect or incomplete information provided by the customer.

The use of credit-based payment methods is subject to the payment service provider’s or creditor’s own age, identification and creditworthiness requirements.

3. Placing an Order and Formation of the Contract

The customer places an order by adding products to the shopping cart, providing the requested information, selecting the delivery and payment methods and confirming the order. The customer must verify the contents of the order and the information provided before confirming the order.

An order placed through the online store becomes binding on the customer once the customer has confirmed and paid for the order or agreed to the terms of the selected payment method. Drivos Oy will send an order confirmation to the email address provided by the customer.

The customer should retain the order confirmation for any subsequent enquiries, returns or complaints.

The statutory right of withdrawal applicable to distance sales does not apply to purchases made and paid for at the Drivos Oy premises in Joensuu. Any exchange or return of an in-store purchase must be agreed separately.

4. Products, Product Information and Availability

Drivos Oy aims to present product information, images, prices and availability information as accurately as possible.

The colours and details shown in product images may differ slightly from the actual product due to factors such as screen settings, photography conditions or minor product modifications made by the manufacturer. The essential characteristics of a product are determined by the product description and the order confirmation.

Product availability information is based on the inventory of Drivos Oy and information provided by manufacturers, importers and other suppliers.

If, in exceptional circumstances, an ordered product is unavailable or its delivery is substantially delayed, we will inform the customer as soon as possible. In such cases, we will agree with the customer whether to replace the product, wait for delivery or cancel the order and issue a refund.

Orders are generally delivered as a single shipment. Drivos Oy may deliver an order in several shipments without charging the customer any additional delivery costs.

5. Prices and Pricing Errors

Prices displayed to consumers in the online store include the applicable value-added tax unless otherwise stated. Delivery costs are added to the order at checkout according to the selected delivery method.

The price of an order is generally determined by the price displayed in the online store at the time the order is placed.

Drivos Oy is not bound by an obviously incorrect price where the customer should reasonably have understood that the price was exceptionally low or otherwise incorrect. Such a situation may arise, for example, as a result of a system error, integration error, data transmission error or an obvious data entry error.

If an obvious pricing error is identified in an order, we will inform the customer as soon as possible. The customer may then accept the correct price of the product or cancel the affected product or the entire order. If the customer does not accept the corrected price, the affected product will be cancelled and any payment made by the customer will be refunded.

6. Payment

The available payment methods are displayed at the online store checkout. The availability of payment methods may vary depending on the order, delivery country, customer information and the terms of the payment service provider.

Payment processing may be carried out by an external payment service provider used by Drivos Oy. The payment method may be subject to the terms and conditions of the payment service provider, card issuer or creditor.

Drivos Oy does not store the customer’s complete payment card details in its own online store systems.

The relevant creditor is responsible for granting credit-based payment methods, making credit decisions, issuing invoices, charging interest and determining other credit terms.

7. Campaigns, Discount Codes and Free Gifts

Campaigns and discount codes are valid for the stated period and subject to the stated terms. Discount codes cannot be combined with each other or with other offers unless otherwise stated in connection with the campaign.

A discount code must be used when placing the order. As a general rule, discounts cannot be applied retrospectively to an order that has already been confirmed.

If the customer returns products in such a way that the conditions of the campaign or discount are no longer met, the value of the order and the amount to be refunded may be recalculated without the campaign benefit.

If the order included a free gift, the unused free gift must also be returned if the products that qualified the customer for the gift are returned. If the free gift is not returned, its stated value may be deducted from the amount refunded to the customer.

8. Delivery

The available delivery methods, delivery costs and estimated delivery times are displayed in the online store when placing the order.

Drivos Oy may, where necessary, replace the delivery method selected by the customer with an equivalent delivery method if the original delivery method cannot be used. The change will not result in any additional costs to the customer. If no equivalent delivery method is available, we will contact the customer to agree on another delivery method or cancellation of the order.

9. Withdrawal, Returns and Exchanges

Consumer customers have the right under the Finnish Consumer Protection Act to withdraw from most orders for goods placed through the online store within 14 days of receiving the product.

10. Business and Organisational Customers

The 14-day right of withdrawal provided under consumer protection legislation does not apply to business or organisational customers.

Drivos Oy may grant business and organisational customers the right to exchange or return standard, unused and resaleable stock products, subject to return costs equivalent to those applicable to consumer customers. Any return or exchange must always be agreed with Drivos Oy in advance.

The right to exchange or return large product quantities, wholesale purchases, specially ordered products, individually sourced products and orders customised for a business customer will be considered on a case-by-case basis. Unless otherwise agreed in writing, Drivos Oy is under no obligation to accept the return of such products.

Business customers are responsible for transport costs and other costs arising from a return unless the return is due to a product or delivery defect for which Drivos Oy is responsible or unless otherwise agreed in writing.

11. Warranty and Liability for Defects

The scope, validity period and terms of any warranty granted for a product are determined in accordance with the warranty terms of the manufacturer, importer or other party providing the warranty. The warranty claim may be inspected and the warranty decision may be made by the warranty provider or an authorised service centre.

A warranty does not restrict the statutory rights granted to consumers under the Finnish Consumer Protection Act. As the seller, Drivos Oy is liable for defects in products as required by law.

Any defect discovered in a product must be reported to Drivos Oy as soon as possible. Use of the product must be discontinued if continued use could worsen the defect, cause additional damage or compromise safety.

Complaints should preferably be submitted in writing by email to info@drivos.com or through the contact form. The complaint should include the order number, product details, a description of the defect and, where possible, photographs or a video of the defect.

If the product is found to have a defect for which Drivos Oy is responsible, the defect will be remedied in accordance with the Finnish Consumer Protection Act, primarily by repairing the product or supplying a defect-free replacement. If the defect cannot be remedied, the consumer may be entitled to a price reduction or cancellation of the purchase.

The warranty and statutory liability for defects do not cover faults or damage caused, for example, by incorrect installation, use contrary to the instructions, external damage, negligence, normal wear and tear or unauthorised modifications to the product.

If an inspection determines that the product does not have a defect covered by the warranty or consumer protection legislation and that the fault was caused by the customer, Drivos Oy may charge reasonable inspection and delivery costs that have been communicated to the customer in advance.

12. User Accounts, Reviews and Website Content

The customer is responsible for keeping their user account credentials and password secure and for all activity carried out through their user account. Any unauthorised use of a user account must be reported to Drivos Oy as soon as possible.

Product reviews and other content published by customers must not contain unlawful, offensive, misleading or inappropriate material or content that infringes the rights of others.

Drivos Oy may refuse to publish or may remove content that violates these Terms, applicable law or generally accepted standards of conduct. A factual negative product review will not be removed solely because it is negative.

The texts, images, videos, trademarks, graphics and other content on the website belong to Drivos Oy or their respective rights holders. Copying, republishing or commercially using such content without the permission of the rights holder is prohibited unless otherwise permitted by law.

13. Processing of Personal Data

Drivos Oy processes customers’ personal data in accordance with applicable data protection legislation and the Drivos Oy Privacy Policy.

14. Force Majeure

Drivos Oy is not liable for any failure or delay in performing its contractual obligations where such failure or delay is caused by force majeure.

Force majeure means an unforeseeable event or circumstance beyond the reasonable control of Drivos Oy that prevents or materially hinders the performance of the contract. Such circumstances may include, for example, an order issued by a public authority, a widespread industrial action, war, a natural disaster, an epidemic, a serious telecommunications or system failure or an exceptional disruption to transport or the supply chain.

Drivos Oy will inform the customer of the force majeure event and its estimated effect on the order as soon as possible.

15. Governing Law and Dispute Resolution

These Terms and the contract between Drivos Oy and the customer are governed by Finnish law.

In relation to consumer customers, the choice of Finnish law does not restrict any rights granted to the consumer under the mandatory legislation of the consumer’s country of residence.

Any disputes will primarily be resolved through negotiations between the customer and Drivos Oy.

If a dispute between a consumer customer and Drivos Oy cannot be resolved, the consumer may contact consumer advisory services. The consumer may then refer the matter to the Finnish Consumer Disputes Board. Before referring the matter to the Consumer Disputes Board, the consumer must contact Drivos Oy in an attempt to resolve the matter.

A consumer may bring legal proceedings either before the district court of Drivos Oy’s registered domicile or before the district court of the consumer’s own domicile in Finland.

Disputes involving business or organisational customers will primarily be resolved through negotiations and, as a last resort, before the district court of Drivos Oy’s registered domicile.

16. Amendments to These Terms

Drivos Oy may update these Terms, for example, due to changes in its operations, services or applicable legislation.

An order is subject to the Terms that were in force at the time the order was placed. Subsequent amendments to the Terms will not alter an order that has already been placed or reduce any rights acquired by the customer under that order.
